Under the Freedom of Information Act of 2000 (the Act), I am writing to request information regarding the electricity procurement of your Ministerial Department. I have made similar requests to all Ministerial and Non-Ministerial departments of HM Government.

In order to assist you with this request, I am outlining my query as specifically as possible. I would like to receive information about:

  • The company or entity from which your Ministerial Department procures (and previously procured) its electricity
    • The amount (if any) of the procured electricity which comes (or came) from renewable energy sources, but not in the form of Renewable Energy Guarantees of Origin (REGO) certificates.

                      1. The UK Supreme Court does not hold this document. The tender documents for the procurement of this contract are not yet drafted.
                      2. This information is exempt under section 43(2) of the Freedom of Information Act 2000. Section 43(2) is an exemption which protects against prejudice to commercial interests. Section 43 of the FOIA does not provide an absolute exemption to the general entitlement to information. We have therefore considered whether, notwithstanding the exemption, it is in the public interest to release the information.Disclosures which provide the details of companies who have applied for inclusion on each framework would be prejudicial to commercial interests as this may make suppliers unwilling do so in the future as they may not want information on their bids to be made public. Private businesses are under no obligation or expectation of transparent disclosure, as public authorities are, and many suppliers would react strongly to us disclosing their confidential business information. Such disclosure would prejudice their interests and allow them to be potentially undercut; in turn this would prejudice our interests as suppliers may in future choose not to apply for inclusion. This may have a negative effect on the Court's ability to secure quality services which provide value for money.It is in the public interest to disclose information that informs the public of how we spend our money, especially where this relates to the provision of public services. However, while we strive to be transparent, we must also consider the importance of our duty to provide the public with quality and value for money services. As a result of this duty, and the risk of potential prejudice to it posed by the various reasons laid out above, we believe the interest in withholding these costs outweighs that for disclosure. We therefore find that the section 43(2) exemption is appropriately engaged and will not be releasing this information.
                      3. The value of the current cleaning contract is £14k-£17k per month.

                      We have a contract with Capgemini for the UKSC Change Programme, which will be worth over £1m. The contract with Capgemini is to transform and modernise our Court over a two and a half year Change Programme so that we better meet the needs of our users. The transformation will include updating processes, ways of working and through the delivery of a new case management system and website.

                                      1. The UK Supreme Court does not have a full cloud infrastructure. We are hybrid and the area that we do have as hybrid has been running since 2017.
                                      2. The criteria used to choose a cloud provider varies depending on the ask, however UKSC will always look at reliability, SLAs and response times to support, or response times and start up times if servers crash and need to be relocated and booted in another data centre that is not affected.
                                      3. Approximately 30% of the UKSC infrastructure is in the cloud.
                                      4. The supplier is Microsoft Azure.
