Facts
On 8 May 2025, the appellant (who is currently imprisoned) was convicted on two counts of breaching a restraining order. On 8 July 2025, the appellant failed to attend the Crown Court for sentencing and a bench warrant was issued. The bench warrant was executed on 31 October 2025. On 28 November 2025, after the appellant failed to attend court again, a further bench warrant was issued. The appellant applied for the bench warrant to be withdrawn. This application was refused by HHJ Hurst. The bench warrant was executed on 4 February 2026, and the case was adjourned for sentencing on 23 March 2026. The appellant was remanded in custody. The appellant was also refused bail on his application to the Crown Court at Cambridge on 10 February 2026. In the High Court, the appellant sought: (i) an order quashing the decision to remand and (ii) a writ of habeas corpus. Kimblin J refused permission to apply for judicial review of the decision to remand and the appellant’s application for a writ of habeas corpus. The appellant now applies for permission to appeal to the Supreme Court, seeking a writ of habeas corpus.
