Issue

The lawfulness of the designation of an ‘associate’ under the UK sanctions regime in the light of human rights law.

Facts

The appellant is a British citizen who resides in the UK. She is the wife of a designated person under the UK’s sanctions regime. It is not disputed that her husband is a person ‘obtaining a benefit from or supporting’ the Russian government for the purposes of the sanctions regime. He was designated following the invasion of Ukraine in early 2022. His designation has not been challenged. In April 2022, the appellant was also designated, on the basis that there were reasonable grounds to suspect that she was ‘associated’ with her husband within the meaning of the relevant regulations. That designation has had significant and serious effects on her ability to deal with her own property, even – at first – for the purposes of buying basic necessities. The appellant requested the revocation of her designation in November 2022, but an administrative review concluded with a decision to maintain it. She then applied to the High Court to have her designation set aside but was unsuccessful. On appeal to the Court of Appeal her designation was again upheld. The appellant now appeals to the Supreme Court, arguing that her designation breaches human rights law.
